Highest-impact items
Data-center moratorium
Confirmed: Council will hold a 30-minute hearing and may adopt a six-month pause on most development, water and sewer approvals for large data centers. The draft would take effect Oct. 6 and expire by April 6, 2027, or earlier if new regulations are adopted. Minor facilities of no more than 10,000 square feet and five megawatts—and certain accessory facilities—would be exempt.
Why it matters — analysis: This is the meeting’s clearest citywide policy decision. It affects industrial land, electricity and water demand, utility ratepayers, noise, lighting and nearby neighborhoods.
Watch: Amendments to the exemptions, treatment of applications already submitted, and whether Council commits to measurable water- and power-capacity standards.
Housing and zoning hearings
Confirmed:
- Z-43-25, 6309 Litchford Road: Residential rezoning; Planning Commission recommended denial 4-3.
- Z-50-25, 2233 and 2321 Capital Boulevard: Would permit mixed-use development up to 20 stories; commission recommended approval.
- Z-56-25, 4020 Carya Drive: Wake County request involving fleet-maintenance vehicle parking.
- Z-07-26, 3911 Western Boulevard: Would increase permitted height from three to seven stories along the planned Western BRT corridor; commission recommended approval 7-0.
- STC-03-2025: Proposed closing of roughly 2,700 square feet of Midtown Market Avenue right-of-way.
Why it matters — analysis: The Capital and Western cases could substantially increase development intensity on major transit corridors. Litchford presents the sharpest split between additional housing capacity and the Planning Commission’s concerns.
Major spending on the consent agenda
Confirmed by the posted agenda:
- $1.069 million WSP contract for a citywide mobility-hubs study.
- $1.375 million Atlantic Avenue construction change order, supported by a $2.5 million budget transfer for construction and easements.
- $250,000 increase, to an $800,000 ceiling, for management of the city’s 185-unit affordable-housing portfolio.
- Operator contract for the Studios at 2800 low-barrier housing program.
- Up to $1.425 million for the N.C. State transit agreement, described as offset by federal funding.
Watch: These items can pass in one consent vote unless a council member pulls them for discussion.
Special-events rules
Confirmed: Proposed revisions would shorten the standard application deadline from 120 to 45 days, create a lower-impact alley-event category and revise classifications for marches, block parties and other street events.
Why it matters — analysis: The changes could make smaller events easier to organize while altering traffic-control and neighborhood-impact requirements.
Public participation
The posted hearings are the data-center moratorium, Midtown Market Avenue closure and four rezonings—not a standalone general public-comment session. Hearing speakers must participate in person and were required to register by 3 p.m. Friday, Oct. 2; presentation files were due by 5 p.m. that day. Those deadlines have passed. Rezoning testimony is normally limited to eight minutes total per side.
